Definitions
- Affiliates refers to Fairbid International, LLC, Central Metal Source, Inc. and any other entity that directly or indirectly controls, is controlled by, or is under common control or common ownership with CMS or its or their successor in interest.
- Buyer refers to any individual or entity and its representatives registered on the Site to buy Units in compliance with the applicable Buyer Agreement, Terms of Use and Privacy Policy of the Site.
- Non-Titled Unit refers to any used or damaged mobility vehicle, equipment, machinery, and other items that do not require valid title to operate/transfer ownership under federal, state and/or local law.
- Seller refers to any individual or entity and its representatives registered on the Site to sell Units in compliance with the applicable Seller Agreement, Terms of Use and Privacy Policy of the Site.
- Services refers to any and all services provided by CMS through the Site.
- Titled Unit refers to any used or damaged vehicle, truck, motor home, recreational vehicle, scooter, electric car, motorcycle, trailer, special purpose vehicle, or other type of Unit which requires valid title for ownership under federal, state and/or local law.
- Units collectively refers to Titled Units and Non-Titled Units available on the Site.
Where We Collect Information
This Policy applies to information that we collect:
- On the Site
- In email, text, and other electronic messages between You and CMS
- When You communicate with CMS over the phone and in person.
Please read this Policy carefully to fully understand our policies and practices (“Policies”) concerning your information and how We will treat it. If You do not agree with our Policies, your choice is not to use our Site. By accessing or using the Site, You shall be bound by the terms of this Policy. This Policy may change from time to time. Your continued use of this Site after We make changes to the Policy is deemed to be acceptance of those changes, so please check the Policy periodically for updates.
IV. Minors Under the Age of 18
Our Site is not intended for anyone under the age of eighteen (18). We do not knowingly collect data relating to minors. When You register on the Site for our Services as either a Buyer or Seller, You must acknowledge that You are of legal age to make bids on Units and further agree to our Buyer and Seller Agreements.
Information We Collect About You and How We Collect It
We collect several types of information from and about Users of our Site, including the following:
- Individuals – name, date of birth, address, e-mail address, telephone number, fax number, IP address, password and photocopy of government issued photo ID with signature (“ID”);
- Businesses – company name, business address, phone number, fax number, IP address, TIN, and business license information; and
- Non-Personal Information – internet connection, equipment used to access our Site, usage details, search activity, product descriptions viewed, forms submitted, videos watched, security answers, shopping cart data, user preferences, and location data.
We collect this information:
- Directly from You when You provide it to us; and
- Automatically as You navigate through the Site. Information collected automatically may include usage details, IP addresses, and information collected through cookies, web beacons, and other tracking technologies.
Information You Provide to Us
The information that We collect on or through our Site may include:

Additionally, You may provide information to be published or displayed (hereinafter “posted”) on public areas of the Site or transmitted to other Users or third parties (collectively “User Contributions”). Your User Contributions are posted on and transmitted to others at your own risk. We cannot guarantee that your User Contributions will not be viewed by individuals not registered and/or authorized to use the Site.
Information We Collect Through Automatic Data Collection Technologies
As You navigate through and familiarize yourself with our Site, We may use automatic data collection technologies to collect information about your equipment, browsing actions and patterns, including:

- For any other purpose with your consent.
We may also use your information to contact You about services that may be of interest to You.

As noted above, We may disclose personal information that We collect or You provide as described in this Policy:
- To our subsidiaries and affiliates;
- To contractors, service providers, and other third parties that We use to support our business;
- To a buyer or other successor-in-interest in the event of a sale, merger, restructuring, reorganization or other transfer of some or all of CMS’s assets, whether as a going concern or as part of a bankruptcy, liquidation or similar proceeding, where personal information held by CMS about our Users is included in the assets transferred;
- To fulfill the purpose for which You provide it. For example, if You give CMS an email address to use the “email a friend” feature of our Site, We will transmit the contents of that email and your email address to the recipients;
